First UDRP for a dot .XYZ domain.

After more than 230,000 robo-registrations of .XYZ domains at Network Solutions, it was bound to happen: the decision for the first UDRP for a dot .XYZ domain name was just delivered.

American Eagle Outfitters filed the UDRP at the National Arbitration Forum; the case involved the domain AEO.xyz, registered at Uniregistry. The Complainant operates from AEO.com and AE.com.

Despite attempts by the Respondent to set up a temporary “educational” web site with references to “AEO vowels” and “generation X, Y, Z” the damage was done when prior to that, the domain was parked at Sedo displaying ads related to clothing.

On top of that, the Complainant seemed to point out that the Respondent is in the business of selling domain names for profit.

Obviously, that alone is not an indication of bad faith use, but the Respondent did not involve an attorney and presented his basic arguments about his rights to own and operate AEO.xyz.

None of that convinced the sole panelist, Dr. Katalin Szamosi, who ordered AEO.xyz to be transferred to the Complainant.
