Romanian dance music idol, Alexandra Stan hit it big in 2010 with “Mr. Saxobeat” – a single that sold more than 10,000,000 copies worldwide.

Alexandra Stan’s stratospheric success continued until 2013, when she was hospitalized; the initial statement of being involved in a car accident was followed up by accusations of a physical assault by her former manager. Their relationship deteriorated and Alexandra Stan filed a criminal complaint.

Meanwhile, her official web site, hosted at the domain name AlexandraStan.ro went offline, and she took a break for a year, before releasing her new single “Dance” on July 18th, 2014.

While the stunning Romanian is expected to hit it big once again, she just lost the UDRP that was filed for her domain name, AlexandraStan.ro at the WIPO. The UDRP was filed against MAAN MUSIC STUDIO SRL of Romania.

A single member panel consisting of Marilena Comănescu, made the following statement regarding the claims by the Complainant, Alexandra Stan:

“Between Applicant and Respondent are a management contract and artistic concluded on May 15, 2009 and valid until 15 May 2017 […] The applicant has pending trademark registration “ALEXANDRA STAN” which is virtually identical in the disputed domain name. The fact that the mark is later disputed domain name registration is not relevant to the first element of the UDRP […] Registering the domain name in dispute was made when the parties were interdependent relationship of cooperation […] The Panel issued its decision knowing that losing plaintiff in the proceedings in this forum does not prevent the applicant to seek a different solution to a different judge other legal authority such as for example the courts.”

In other words, the Complainant and the Respondent have an existing business contract until 2017, and the current status of their relationship concludes that there is no bad faith in the registration of the domain name, AlexandraStan.ro which occurred as part of a mutually agreed contract.

The panelist thus decided to deny the UDRP’s request and the domain should remain with the Respondent. The decision identifies an important lesson to be learned: Artists and other creative individuals should register and own full rights to their personal web sites, before entering into a managerial agreement.
