There is a company that owns a domain name that I want. currently could be trademark sisue but they are going out of business anyways. shutting all store doors for good. There domains registered until 2023.
Should I email them about purchasing it?

Maybe. Or approach the liquidator if there is one appointed. It depends on the circumstances of the closure.

The RadioShack bankruptcy domain sale can give a lesson, if someone buys askradioshack.com from them they might still have tm problems. It can be a big legal mess

Also if the business your'e talking about is in bankruptcy court, they cant just do an off hand deal with you. They are under court order to sell to the highest bidder.

When the companies get liquidated, the assets become property of the liquidators, and there is not much opportunities for deals, they want to maximize their profit (assuming your are looking for a deal).

If the company is in liquidation, talk to the liquidators. If the company is not in liquidation, talk to the owner.

Even if the company is in the liquidation process, does this necessarily mean that the rights on TM will also pass to the liquidation company? I mean, getting a domain that is certainly trademarked, is maybe not the best idea? Unless you make sure and get covered on the legal side.

TMs can be added to the assets inventory. But that is up to the liquidators I guess.

I don't understand why people like TM names so much?

There are about 4,643 posts on this Forum advising people to stay away from them.
I guess it's just like marriage, you know you make a wrong decision but you still do it anyway!!!!
