i would start by sending them an email to transfer the domain out.

If the site and email are down you can always try to mail them.

Then I would look and see who the upline domain company. In most cases a lot of resellers use enom. So you could then contact them.

provide them data showing you bought the domain, that the company you got it from is no longer in business. at that point they should be able to move the site for you

I'd say it's a very broad subject. Even taking one aspekt at a time - let say provider close-down we have multiple options:
    - if provider is a reseller and not a direct registrar - policies of his registrar (like Enom, Directi) would apply as mentioned above,
    - if provider is the acredited registrar and go bankrupt despite all the requirements of the registry policies of the specyfic registry (like Verisign for .com, local ccTLD etc.) as well as ICANN (if registry is part of it) would apply.
Those policies of course might be different for each TLD as there are many of them - but from what I know would usually provide way to move the domain to different registrar. Temporary sometimes registry will also act as registrar.

First thing would be to check in WHOIS who is the registrar - if it's the given provider or someone else (like mentioned Enom).

I don't think any registrar will move the domain without the confirmation from the real owner, who in this case will be the reseller. They will always ask you to contact the reseller and ask him to move your domain to your account.

Resellers don't own domain names (unless they put their own name in the "registrant" field, which they shouldn't do). The registrant is the owner.

If a reseller disappears then the owner (registrant) will need to contact the registrar. Registrars have procedures in place for this scenario. In the one case where I assisted a registrant in retrieving their domain name from a defunct reseller the registrar contacted the reseller and gave them 14 days to respond. At the end of the 14 day period the registrant was given direct control of their domain name, enabling them to transfer it out.

I believe they would NEED to give customers the ability to still access and move their domains. They wouldn't just steal them, lol.

Who do you mean by "they" - the (hypothetical) defunct reseller?

They may not always have that option, if their premises have been repossessed and/or their web site has been cut off because they haven't paid for their servers.

With the domain name that I had to rescue the reseller's web site was still up but there was clearly "no one at home" - phones weren't being answered, email wasn't being answered. Other than by contacting the registrar my client would not have been able to rescue their domain name.
